Terms of service

 

These terms and conditions apply to all agreements you enter into with ZONE2. By placing an order with ZONE2, you agree to the terms outlined below.

1. Definitions

The following terms are used in these terms and conditions with the associated meanings:

  • Webshop: the online store of ZONE2, accessible via www.zone2sportswear.com.
  • Customer: the natural or legal person entering into an agreement with the webshop.
  • Agreement: any agreement established between the customer and the webshop, including the terms outlined below.
  • Products: all sports accessories and related items offered on the webshop.

2. Applicability

2.1 These general terms and conditions apply to all offers, orders, and agreements of ZONE2. 
2.2 Deviations from these general terms and conditions are only valid if agreed upon in writing by ZONE2 and the customer.
2.3 If one or more provisions in these general terms and conditions are at any time wholly or partially null and void or annulled, the remaining provisions shall remain fully applicable. 
2.4 In the event of discrepancies or differences in interpretation between the various translations of the website (including, but not limited to, product pages, terms and conditions, and policies), the provisions and descriptions of the Dutch version shall prevail over the translations.

3. Offer and agreement

3.1 Every offer on the webshop is non-binding and subject to stock availability.
3.2 An agreement is established when the customer places an order and receives an order confirmation from ZONE2.
3.3 ZONE2 reserves the right to refuse orders or impose additional conditions. If an order is not accepted, ZONE2 will notify the customer within 5 business days after receiving the order.

4. Prices and payment and Marathon Campaign

4.1 All prices listed on the webshop are in euros, including VAT but excluding shipping costs, unless stated otherwise. 4.2 ZONE2 reserves the right to change prices, in particular when required by (legal) regulations.
4.3 The customer can pay using the payment methods offered on the webshop, such as iDEAL, credit card, or Klarna. 4.4 Payment must be made immediately upon placing the order. Products will only be shipped after full payment has been received.
4.5 The Marathon Weeks promotion applies to purchases where a unique code is used by an existing customer at ZONE2. The Marathon gift is provided while supplies last. ZONE2 may choose to offer an alternative when Marathon Weeks gifts are fully out of stock but is not obliged to do so.
4.6 To qualify for the additional Marathon Weeks discount, the customer must use the designated discount code.
4.7 ZONE2 reserves the right to change the terms of the Marathon Weeks at any time (including shortening or extending the duration) or to terminate the promotion without prior notice.
4.8 Misuse of the Marathon Weeks promotion, such as the use of multiple accounts by the same person, will result in exclusion from participation and may lead to the withdrawal of the discount.

5. Delivery

5.1 ZONE2 strives to process and ship the order within 1–3 working days after receipt of payment, unless another term is specified.
5.2 Delivery takes place at the address provided by the customer.
5.3 Delivery times are indicative. Processing and delivery may take longer in the last quarter due to increased demand. Exceeding any delivery term does not entitle the customer to compensation.
5.4 If a product is out of stock or cannot be delivered within the stated period, ZONE2 will inform the customer as soon as possible and propose an alternative delivery term or offer a replacement product.
5.5 The customer must contact the courier directly before any complaints regarding shipping can be processed.
5.6 ZONE2 is not liable for (consequential) damage resulting from an incorrect delivery address provided by the customer.
5.7 If the delivery service registers the status as “delivered,” ZONE2 may assume that the order has been correctly delivered. ZONE2 is not liable for loss or damage after this delivery scan unless there is proven error or negligence on the part of ZONE2 or the delivery service provider.

6. Right of withdrawal and returns

6.1 The customer has the right to withdraw from the agreement within 30 days after receiving the products, without stating any reason. The products must be received by ZONE2 within these 30 days.
6.2 During the withdrawal period, the customer must handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to determine whether the customer wishes to keep it. Products that are not suitable for return due to hygiene reasons (such as socks and underwear) are excluded from returns. Products delivered with a seal are also included in this exclusion.
6.3 To exercise the right of withdrawal, the customer must notify ZONE2 in writing or by email within the withdrawal period.
6.4 The costs of returning the product are borne by the customer, unless otherwise agreed. This also applies when a package is automatically returned due to the customer’s actions, such as not being at home during delivery, not collecting the package from a pickup point, or providing incorrect address details that were not corrected in time. The customer is responsible for this and will be refunded minus these return costs.
6.5 The customer is responsible for correctly returning products. The risk of loss or damage during the return process lies with the customer unless ZONE2 has arranged the return shipment itself or has required the customer to use a carrier designated by ZONE2. ZONE2 advises customers to always use a reliable trackable shipping method (for example, with track & trace from DHL, DPD, or PostNL) and to keep proof of shipment.
6.6 ZONE2 will, after receiving the returned shipment, unless otherwise agreed or communicated, refund the full purchase amount as soon as possible, but no later than within 14 days.
6.7 Pre-orders cannot be canceled. Once a pre-order has been placed, it becomes final and cannot be withdrawn until the moment of delivery. The right of withdrawal starts from the moment the product is received.

7. Warranty and complaints

7.1 ZONE2 warrants that the products comply with the agreement, the specifications stated in the offer, and the reasonable requirements of soundness and usability.
7.2 The customer must inspect the products immediately upon receipt. Any visible defects or complaints must be reported to ZONE2 in writing within 7 days.
7.3 If the complaint is deemed valid by ZONE2, ZONE2 shall have the option to repair the product, replace it, or refund the paid amount upon receipt of the product. This order is binding.
7.4 Other complaints, subject to Article 7.2, can be submitted via the contact details on the ZONE2 website, www.zone2sportswear.com. Complaints received will be answered within 14 days.
7.5 The following damage is not covered by the warranty:
a) damage resulting from normal wear and tear of the product(s)
b) damage resulting from transport or storage of the product(s)
c) damage resulting from improper use of the product(s) or poor maintenance
d) damage resulting from failure to comply with the usage and maintenance instructions of the product(s) as defined in the manual of the product(s) under “details” on the product page and/or what is considered customary in normal use
e) damage resulting from modification of the product(s) or repair by an entity other than ZONE2, including attempting to repair the product yourself
f) damage resulting from shocks caused by sharp objects, twisting, compression, dropping, abnormal impacts, and other actions beyond ZONE2’s control.

8. Liability

8.1 ZONE2's liability related to the sale of products is limited to the purchase price of the product unless there is intent or gross negligence.
8.2 ZONE2 is not liable for indirect damages, including consequential damages, lost profits, missed savings, or business interruption.
8.3 The customer indemnifies ZONE2 against all third-party claims related to the delivery of products by ZONE2.

9. Privacy and Data Protection

9.1 ZONE2 respects the customer's privacy and ensures that personal data is handled confidentially.
9.2 Personal data is processed in accordance with applicable privacy laws and ZONE2’s privacy policy.
9.3 Customers have the right to access, correct, and delete their personal data as described in the privacy policy.

10. Force majeure

10.1 ZONE2 is not obliged to fulfill its obligations under the agreement if prevented by force majeure. Force majeure includes any circumstance beyond ZONE2's control that temporarily or permanently prevents the fulfillment of the agreement.
10.2 In the event of force majeure, ZONE2 has the right to suspend the agreement or terminate it without being liable for damages.

11. Governing law and disputes

11.1 All legal relationships involving ZONE2 are governed exclusively by Dutch law.
11.2 Disputes between the customer and ZONE2 will be submitted exclusively to the competent court in the district where ZONE2 is located, unless mandatory law dictates otherwise.

12. Changes to terms and conditions

12.1 ZONE2 reserves the right to amend or supplement these terms and conditions at any time.
12.2 Minor changes may be implemented at any time.
12.3 Substantial changes will be discussed with the customer in advance and will take effect 30 days after notification.
